Florida DUI Penalties

First Offense

  • Up to 9 months in jail
  • Fines up to $1,000
  • DUI counseling
  • Vehicle Impoundment for 10 days
  • License suspension for up to 1 year
  • 50 hours of community service
  • Probation for up to 1 year
  • Vehicle ignition interlock device installation
  • Possible deportation if driver is a non-U.S. citizen

Second Offense (within 5 years)

  • Up to 12 months in jail
  • Fines up to $2,000
  • Mandatory DUI counseling
  • Vehicle Impoundment for 30 days
  • License suspension for up to 5 years
  • 50 hours of community service
  • Probation for up to 1 year
  • Vehicle ignition interlock device installation for up to 2 years
  • Possible deportation if driver is a non-U.S. citizen

Third Offense (within 10 years)

  • May be charged as a felony offense
  • Up to 5 years in prison
  • Fines up to $5,000
  • Mandatory DUI counseling
  • Vehicle Impoundment for 90 days
  • License suspension for up to 10 years
  • 50 hours of community service
  • Probation for up to 5 years
  • Vehicle ignition interlock device installation for a minimum of 2 years
  • Possible deportation if driver is a non-U.S. citizen
