Is the case based on military or Florida law?
In a divorce cases both military code and Florida law needs to be considered. Florida law will generally govern the case, but military code may govern how military benefits are distributed in a divorce.
Is adultery considered in military divorce?
Since Florida is a no-fault divorce state, adultery is normally irrelevant to the case. Therefore, it is generally not allowed to even be discussed during the case. However, please keep in mind there may be consequences for adultery under military law.
What happens to Military Retirement accounts in divorce?
Depending on the length of the marriage, the retirement account may need to be divided in the divorce case. The exact amount will depend on the specifics of each case, including the length of the marriage.
Can I file divorce while active duty?
Yes, you can still file for divorce while active duty. We have the capability to assist our military clients by phone and email. Also, judges will usually allow service members to attend court hearings by phone.
